Terms of Service for Electronic Services Provision Naya Yoga Club Sp. z o. o.

§1 General Provisions

  1. These terms and conditions ("Terms") define the rules for using the website www.nayayogaclub.pl (the "Site"), owned by Naya Yoga Club Sp. z o. o., with its registered office in Bydgoszcz, ul. Śniadeckich 18, 85‑011, Poland, NIP: 9671486218, REGON: 541425887, KRS: 0001166909.

  2. Through the Site, Users may purchase yoga passes for classes held at the studio’s premises and make online payments.

  3. Use of the Site constitutes acceptance of these Terms.

  4. The service provider ("Provider") is Naya Yoga Club Sp. z o. o., and the user ("User") is any natural or legal person using the Site’s functionalities.

 

§2 Site Usage Rules

  1. To use the Site, you need a device with Internet access and an up‑to‑date web browser.

  2. The User agrees to use the Site lawfully, in good faith, and in accordance with these Terms.

 

§3 Purchase of Passes

  1. Users may purchase yoga passes via the form available on the Site.

  2. Prices are stated in Polish zloty (PLN) and include all legally required taxes.

  3. A pass purchase is completed upon submitting the required data and completing the online payment.

  4. A purchase confirmation will be sent to the email address provided by the User.

 

§4 Payments

  1. Payments for passes are processed through Przelewy24 (www.przelewy24.pl).

  2. Electronic payment services are provided by PayPro SA, ul. Pastelowa 8, Poznań, KRS: 0000347935.

  3. Naya Yoga Club Sp. z o. o. does not store Users’ payment card or online banking credentials.

  4. If a payment is not received, the transaction may be canceled.

 

§5 Complaints

  1. Right to Complain Participants may file a complaint regarding services provided by Naya Yoga Club if they believe services were not rendered in accordance with the contract, these Terms, or applicable law.

  2. Form of Complaint Complaints may be submitted:

    • In writing, to the studio’s registered address,

    • By email to the studio’s email address,

    • In person at the studio’s reception.

  3. Complaint Deadline Complaints must be filed within 14 calendar days from the date of the event giving rise to the complaint.

  4. Required Information

    • Participant’s name and surname,

    • Description of the issue,

    • Proposed resolution (if applicable).

  5. Complaint Handling The studio will review complaints within 14 business days of receipt and respond by email or in writing.

  6. No Response If no response is provided within the above term, the complaint is deemed resolved in the Participant’s favor.

  7. Alternative Dispute Resolution In case of disputes, Participants may use out‑of‑court dispute resolution methods, e.g., mediation at the Regional Inspectorate of Trade Inspection.

 

§6 Withdrawal and Refunds

  1. Users may withdraw from the purchase agreement within 14 days of purchase, provided the pass has not yet been used.

  2. To withdraw, Users must email reklamacje@nayayogaclub.pl with a statement of resignation.

  3. Refunds will be processed within 14 business days of receiving the withdrawal notice.

  4. No refunds are available for classes already started (per Art. 38 of the Consumer Rights Act).

 

§7 Liability

  1. Naya Yoga Club is not liable for Site outages due to technical reasons beyond the Provider’s control.

  2. The Provider is not responsible for damages resulting from improper Site use or data entered by the User.

 

§8 Data Protection

  1. The data controller is Naya Yoga Club Sp. z o. o.

  2. Personal data are processed to fulfill orders and communicate about studio operations.

  3. Detailed data processing information is available in the Privacy Policy on the Site.

 

§9 Final Provisions

  1. Naya Yoga Club Sp. z o. o. reserves the right to amend these Terms. Changes take effect 14 days after publication on the Site.

  2. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Act on Electronic Services.

  3. Any disputes will be resolved by the competent common courts.
